GENERAL POSITION SUMMARY:
The Contracts Manager will assume responsibility for development, management, and maintenance of all major commodity and service contracts of Mercy Corps’ Turkey office.  The Mercy Corps office provides substantial material aid to persons displaced by the conflict in Syria, and maintains numerous contracts with commodity and transportation suppliers to ensure that aid is effectively and efficiently delivered to those who need assistance.  The Contracts Manager will play a major role in this effort by ensuring that contractual arrangements with suppliers are clear, economical, and efficient and that the tasks necessary to maintain contracts and strong supplier relationships are performed with expedience and diligence. To be successful in this role, the chosen candidate will have significant experience in international procurement and contract management, along with exposure to or experience of international field logistics.  Highly developed interpersonal and communication skills, and significant experience in negotiating with stakeholders and suppliers, is required.

PROGRAM/ DEPARTMENT SUMMARY:
The  program provides emergency food and non-food items to families affected by the Syrian Crisis.


ESSENTIAL JOB FUNCTIONS:
Contracts Management:
  • Oversee major functions of contract management, including drafting, evaluation, negotiation and execution.
  • Serve as the MC point of contact on contractual matters for major vendor contracts, acting as contractual “middleman” between MC employees and vendors.
  • Monitor and shepherd review, approval, reconciliation, and amendment processes to ensure timely movement of contract actions through the MC workflow processes.
  • Participate in tendering process to ensure invitational documents adequately and appropriately align with anticipated contractual terms and conditions.
  • Advise when specific tenders and market-testing exercises need to be conducted, and provide commercial advice, assistance and/or leadership of these exercises.
  • Ensure that signed contracts are communicated to all relevant parties to provide contract visibility and awareness, and assist with interpretation of contract terms to support implementation.
  • Liaise with program teams regularly to ensure their needs are being met.
  • Liaise with quality control team weekly to ensure that contractors are meeting their contractual obligations in terms of content and specification of goods provided.
  • Monitor transaction compliance (milestones, deliverables, invoicing, etc.).
  • Handle on-going issue and change management.
  • Monitor contract close-outs, extensions and/or renewal.
  • Provide regular reviews and updates on the status of ongoing contracts to Expanded Strategic Management Team.
  • Adapt language in standard Mercy Corps HQ contract templates to create new contract templates that meet the specific needs of the MC Turkey office.
  • As needed, provide guidance on contract matters to project managers or operational staff, including training to new project managers and other employees in contracting practices and procedures.
  • Maintain up-to-date knowledge on relevant country business norms, legal conditions, and customs, and ensure this information is incorporated in contract agreements as required.
  • Work with Finance to ensure adherence to broader finance and risk requirements defined in donor agreements or donor policy.
  • Coordinate closely with Mercy Corps headquarters staff to secure additional technical, financial, contract, and legal support as needed.
  • Develop and implement procedures for contract management and administration in compliance with Mercy Corps and donor policies.  As appropriate, contribute to or influence company policies.
  • Monitor vendor satisfaction with our terms and conditions and contracting practices.
  • Recommend changes to improve Mercy Corps ability to procure needed goods and services on an ongoing basis.

REPORTS DIRECTLY TO:  Country Operations Manager
ACCOUNTABILITY:  Works with Procurement Team, with Procurement manager, Program manager, finance team and Compliance Manager.

KNOWLEDGE AND EXPERIENCE:
  • Bachelor’s degree in Business Administration, Management Science, International Development or related field.
  • 3-5years’ of senior management experience with knowledge and experience in contracts management.
  • Demonstrated experience in preparing and interpreting complex and sizeable contracts, preferably within the relief and development, transportation, or consumable commodity sectors.
  • English language fluency; Turkish language proficiency preferred.
  • Superior writing skills. Proficient ability in Microsoft Word, Excel, and project/supply chain management software.
  • Organizational skills and flexibility to complete critical tasks on time.
  • Ability to work with minimum supervision in a team environment.

SUCCESS FACTORS:
Critical is problem solving, and the ability to work out methods to deliver successful programs while demonstrating excellent stewardship of donor funds and compliance with MC and donor regulations. Maintaining strong cooperating relationships with other departments is crucial. A successful candidate will have the ability to interact effectively with international and national personnel both in a managerial as well as training capacity and demonstrate ability to multi-task, meet deadlines and process information in support of changing program activities. S/he will be able to live and work closely with a diverse team of individuals in a highly intense and fluid work and security environment and be willing to travel to Mercy Corps business related sites.

LIVING CONDITIONS/ENVIRONMENTAL CONDITIONS:
This unaccompanied position will be based in Gaziantep, Turkey. The location is unaccompanied and low level insecure although the exact location of this post is considered safe. Housing is group accommodation with excellent freedom of movement beyond the house/office. Staff will have access to good medical services in Gaziantep. Electricity and water are not common problem in this city

Mercy Corps Team members represent the agency both during and outside of work hours when deployed in a field posting or on a visit/TDY to a field posting. Team members are expected to conduct themselves in a professional manner and respect local laws, customs and Mercy Corps' policies, procedures, and values at all times and in all in-country venues.
